The purpose of this policy is to inform you, in accordance with European Regulation No. 2016-679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the “Regulation” or “GDPR”), of our practices regarding the collection, use and sharing of information that you may provide us through our website (hereinafter the “Site”).

This policy aims to inform you about the categories of personal data that we may collect or hold about you, how we use them, with whom we share them, how we protect them, and the rights you have over your personal data.

This policy aims to inform you about the categories of personal data that we may collect or hold about you, how we use them, with whom we share them, how we protect them, and the rights you have over your personal data.

What is personal data?

The term “personal data” refers to any data that allows you to identify yourself as an individual. When you use the website (the “Site”), we may ask you to provide us with certain personal data about you.

What personal data do we collect?

By using our Site and as part of the missions that we carry out for your account, you are required to provide us with information, some of which is likely to identify you and thus constitute personal data (hereinafter referred to as “Data”). These Data include, among others, data (i) of identification (name, first name, address, email), (ii) of transaction (RIB for payment), (iii) technical (if necessary for the operation of the Site), (iv) related to the coaching mission that we offer (which may include special data) and (v) related to your navigation on our Site.

How do we use the data we collect and on what legal basis?

Simple consultation of the Site does not require registration or prior identification. It can be done without you communicating any personal data about yourself.

However, when you decide to subscribe to the information on our Site, contact us directly through the Site, or respond to surveys, or send us feedback, we collect this information in a strictly necessary framework for the realization of our mission.

The data collected are used for:

  • Executing the coaching missions that you entrust us with, managing contracts, invoicing and monitoring the commercial relationship with you. The processing is based on the execution of the contract;
  • Carrying out commercial prospecting operations. This processing is based on our legitimate interest;
  • Managing accounting and complying with our tax obligations. This processing is based on a legal obligation;
  • Responding to your requests for information and contact made on our Site. This processing is based on your consent;
  • Helping us to preserve a healthy and secure environment on our Site. This processing is (i) based on our legitimate interest (ensuring the security of the Site), (ii) necessary to comply with our legal obligations and/or (iii) necessary to establish, exercise or defend a legal right;
  • Managing our Site and performing internal technical operations in the context of problem solving, data analysis, testing, research, analysis, studies and surveys. This processing is based on our legitimate interest (ensuring the security of our Site and improving its features).

When collecting the Data, you will be informed if certain Data must be provided or if they are optional. Otherwise, the execution of your request may be restricted.

Who are the recipients of the data we collect and why do we transmit these data to them?

  1. Data transferred to authorities and/or public bodies

In accordance with the regulations in force, the Data may be transmitted to the competent authorities on request and in particular to public bodies, judicial assistants, ministerial officers, bodies responsible for debt collection, exclusively to comply with legal obligations, as well as in the case of the search for the perpetrators of offenses committed on the internet.

  1. Data transferred internally

The Data collected and processed are transmitted to the team members, assistants, interns, and any internal service of the Company.

  1. Data transferred to third parties

We may work in collaboration with third-party companies or consultants, self-employed entrepreneurs who may have access to your Data, and in particular with:

  • The subcontractors we use for the provision of IT services (database management, hosting, storage, maintenance, etc.), accounting or communication;
  • The agents, consultants, or any third party involved in the coaching missions that we offer.

We only transmit to these third parties the Data they need to perform their services, and we require that they do not use your Data for any other purpose. These third parties will act only in accordance with our instructions and will be contractually obliged to ensure a level of security and confidentiality of your Data identical to ours and to comply with the applicable regulations on the protection of personal data.

How long do we keep your data?

Your Data will not be kept beyond the duration strictly necessary for the purposes pursued as set out in this Policy and in accordance with the Regulation and applicable laws.

In this respect, the Data used for the purposes of executing the missions that you entrust us with are kept for the duration of the contractual relationship, then archived in accordance with the limitation periods.

Your Data is deleted when the retention periods expire.

Archiving means that your Data will no longer be accessible online but will be extracted and stored on an autonomous and secure medium.

The Data used for the purposes of prospecting and communication may be kept for a maximum period of 3 years from the end of the business relationship or the last contact of the prospect concerned.

Your Data is deleted when the retention periods expire. However, your Data may be archived beyond the periods provided for the purposes of research, finding and prosecuting criminal offenses for the sole purpose of making your Data available to the judicial authority.

How are your data protected?

All precautions and appropriate organizational and technical measures have been taken to preserve the security, integrity and confidentiality of your personal data.

In case of recourse to a service provider, we ensure that the latter complies with its security obligations, prior to the communication of your data.

Where are your data stored?

Your data are stored and stored for the duration of their processing on servers located within LWS on an external hard drive or cloud (to be specified).

The IP address may also be collected to determine the city from which you are connecting.

What are your rights over your data and how can you exercise them?

In accordance with the laws and regulations applicable to the protection of personal data, you have a number of rights relating to your Data, namely:

Right of access: you have the right to access your personal data at any time.

Right of rectification: you have the right to rectify your personal data that are inaccurate, incomplete or outdated at any time.

Right of erasure: in some cases, you have the right to obtain the erasure of your Data. However, this is not an absolute right and we may, for legal or legitimate reasons, keep these Data.

Right to restriction: you have the right to obtain the restriction of the processing of your personal data in certain cases defined in art.18 of the GDPR.

Right to data portability: you have the right to receive your personal data in a readable format and to request their transfer to the recipient of your choice.

Right to be forgotten: you have the right to request that your personal data be erased, and to prohibit any future collection.

Right to lodge a complaint: with the CNIL in France, if you consider that the processing of your personal data constitutes a violation of the applicable texts.

Right to object: you have the right to object to the processing of your personal data.

Please note, however, that we may continue to process your Data despite this objection, for legitimate reasons or for the defense of legal rights.

The right to withdraw your consent at any time: you can withdraw your consent to the processing of your Data when the processing is based on your consent. The withdrawal of consent does not affect the lawfulness of the processing based on consent before its withdrawal.

The right to give instructions regarding the fate of your data after your death: you have the right to give us instructions regarding the use of your Data after your death.

Changes and application of the privacy policy

We reserve the right, at our sole discretion, to modify this policy, in whole or in part, at any time. These changes will take effect from the publication of the new policy. We will inform you in advance by any means useful.
